Sioux Falls | Libel claimed after delayed correction

Rory Randal Kelly, part owner of Cellular Only of Sioux Falls, S.D., says his reputation suffered after the Argus Leader incorrectly identified him as having been arrested following a domestic disturbance.

Police had initially identified Kelly, 33, as the man arrested, but later corrected the suspect's identification to Rory Patrick Kelley, 24, according to an Associated Press story cited by Editor & Publisher.

Kelly sued the paper Wednesday. His attorney acknowledged that the first mistake was not the media’s fault. But he said the Gannett paper failed to run a correction for three days, allowing the damage to go on, the A.P. says.

  1. This is an outrageous violation of company policy that requires prompt and immediate correction of clearly erroneous information in stories.

  3. Hope people take note of this and file similar suits. This is just carelessness. How much does Gannett pay to outsource comment review? This just goes to show that leaving it up to readers to police comments simply will not work.

  4. It would be interesting to know who made the big mistake. Did the reporter delay telling editors about the problem, or is this the standard FUBAR situation where the correction just didn't get published?
